Assault Police and Obstructing Arrest

Two brothers were returning home from a bar late at night. Some strangers began taunting the older brother, leading to a small fight. The younger brother – our client – escorted his older brother to a safe location about a block away. When police arrived, the older brother was still upset and refused to identify himself, so the police decided to arrest him. When his older brother was being arrested, our client asked the officers’ permission to film the arrest, but he was himself arrested for allegedly obstructing the arrest.

Our client was charged with assaulting police and obstructing arrest. Despite the nature of the charges, defence counsel proposed a diversionary program that would avoid the costs and risks of trial, which was accepted by prosecutors.

RESULT: The charges against our client were withdrawn.
